Marbella’s luxury market

Marbella is one of the few markets in Europe where luxury homes are bought, to a large extent, from abroad: a good proportion of those who sign on Marbella’s Golden Mile, in Puerto Banús or in Benahavís are not living in Spain at the time of the transaction.

That has a practical consequence. The transaction is negotiated at a distance, in several languages and to short deadlines: the reserva (the reservation agreement, usually signed with the agent against a payment, which may already bind you) is signed within days, and the problems (encumbrances, planning, licences) surface later, once money has changed hands. That is why the legal work comes before the signing, not after it.

Legal due diligence

Before you hand over a single euro: title, encumbrances and debts at the Land Registry (Registro de la Propiedad), planning position, licences and the comunidad de propietarios (the owners’ association). If something is not in order, you will know before signing, not after.

Contracts and completion

Reserva, arras (the deposit contract, whose legal effect depends entirely on how it is drafted) and the contract of sale, negotiated clause by clause. If you cannot travel, we represent you under a notarial power of attorney (poder notarial) and sign before the notario (the Spanish civil-law notary) on your behalf.

Non-resident taxation

The taxes on the transaction and the annual obligations of the non-resident owner (a tax status under the 183-day rule, not a matter of where you live), calculated and explained before completion: Modelo 210, IBI and, where applicable, wealth tax. No surprises in the first year.

Coordination with your residence route

If the purchase is part of your plan to live in Spain, the same team handles both the property file and the immigration (extranjería) file, and the timing of one does not hold up the other.

Buyers’ questions

Yes. You need an NIE (Número de Identidad de Extranjero, the foreigner’s identification number, which confers no residence rights), which we obtain for you, and an account through which to channel the funds. With a notarial power of attorney, the entire transaction can be signed without you travelling.

Title and encumbrances at the Land Registry, planning position and licences, community debts and outstanding taxes, and that what is being sold matches what is registered.

It depends on whether you buy obra nueva (a developer’s first delivery of a new building, taxed with VAT plus AJD) or segunda transmisión (a second or subsequent delivery, as a rule taxed under ITP, the transfer tax set by each autonomous community, rather than VAT) and on how the transaction is structured. Before completion you will receive the full calculation of taxes and costs for your specific case.

In many cases, yes. We review your situation and, where appropriate, coordinate the purchase with the residence route that suits you and your family: non-lucrative residence, the digital nomad visa or another specific permit, since the purchase itself does not confer residence.
